The filing fee is not refundable. A conflicting mark already on the register is the most common reason applications are refused, and it is the cheapest thing to check first.

The USPTO restructured its trademark fees in January 2025. There is now a single base application fee of $350 per class of goods or services, replacing the old tiered system. Two things can add to it. If your application is missing required information, the USPTO adds $100 per class. If you write your own free-form description instead of using the pre-approved Trademark ID Manual wording, the USPTO adds $200 per class for the first 1,000 characters.
If you file on an intent-to-use basis, you pay the base fee now and a Statement of Use fee of $150 per class later, once you are actually using the mark. After registration, you keep the mark alive with maintenance filings: a Section 8 declaration ($325 per class) between years five and six, and a combined Section 8 and Section 9 renewal ($650 per class) every ten years.
On top of the government fees, most applicants pay for help. A filing service typically charges a couple of hundred dollars on top of the USPTO fees. A trademark attorney usually charges several hundred to over a thousand, and is worth it when a name is borderline or spans several classes. You are allowed to file yourself if you are based in the US; foreign-domiciled applicants must use a US attorney. Confirm the current numbers on the USPTO fees page before you file through TEAS.

Why is the trademark fee charged per class?
Each NICE class you file in is, in effect, a separate registration bolted onto one application, and the USPTO charges the $350 base fee for every class. A brand covering products and retail services in two classes pays $700 in base fees.
What is the $200 custom identification surcharge?
Since January 2025 the USPTO charges $350 per class only if you describe your goods or services using its pre-approved Trademark ID Manual wording. If you write your own free-form description, it adds $200 per class for the first 1,000 characters, and another $200 for each additional 1,000.
Do I need a lawyer to file a trademark?
US-based applicants are not required to use an attorney, though the USPTO recommends one. Foreign-domiciled applicants must have a US-licensed attorney. An attorney costs more but lowers the chance of a refusal that wastes the non-refundable filing fee.
Is the trademark filing fee refundable if I am refused?
No. The USPTO filing fee is not refunded if your application is refused or abandoned. That is why a clearance search before you file is worth the few minutes it takes.
